– Information You Give Us:
We receive and process any information you enter on our website or give us in any other way, except for fields that are expressly marked differently, such as “Search with Google”, “Twitter” or “Facebook” which are processed by the respective companies. Data we process through entry fields is generally not stored, except for services related to your ShiVa Store account on (full name, address, contact e-mail, password, orders, payment information, ShiVa licenses, product reviews and comments), the forum (name, contact e-mail, password, anything you voluntarily post on our message board), the bug tracker (name, e-mail, ShiVa license, anything you post on our bugtracker), and the support system (name, e-mail, support request text).

You can choose not to provide any such information and still use parts of our website, such as the online documentation, however vital aspects of our website such as the Online Store and License Management will not be available to you. We reserve the right to periodically look over our customer database and purge any customer entries with clearly fraudulent data, such as invalid names, addresses, bot accounts and the like.

– Automatic Information:
We receive and store certain types of information whenever you interact with us. For example, like many websites, we use “cookies” and we obtain certain types of information when your web browser accesses any of our websites.

ShiVa license management furthermore relies on an automatically generated computerID string which is used to uniquely identify a development computer in our database. This computerID string is generated by the ShiVa software and exclusively used for verification of your license with our license server.

If you upload images or videos to the website, namely the forum, gallery and bug tracker, you should avoid uploading images with embedded location data (e.g. EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. ShiVaTech cannot be held responsible for the personal information contained in files you voluntarily upload to our server.

We use “cookies” on this site. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site. We use cookies to recognise your browser or device, and provide you with essential features and services and for additional purposes, including:

– Recognizing you when you sign-in to use our services. Without signing in, you will not be able to use our store, bugtracker, forum or beta archive.

– Preventing fraudulent activity.
– Improving security.

If you block or otherwise reject our cookies, you will for instance not be able to add items to your Shopping Basket, proceed to Checkout, or use any ShiVaTech products and services that require you to sign in.

How long we retain your data

If you leave a comment, product review, forum post, bug report or service ticket, the content and its metadata are retained indefinitely. All users can see, edit, or delete their personal information at any time (except they cannot change their e-mail address without our help).

If you have an account on this site, or have left comments, product reviews, forum posts, bug reports or service tickets, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Who we share your data with

Information about our customers is an important part of our business and we are not in the business of selling it to others. ShiVaTech shares customer information only as described below.

– Affiliated Businesses ShiVaTech does not control:
We work closely with affiliated businesses. In some cases, such as Marketplace sellers, these businesses operate stores and sell products on our store at You can tell when a third party is involved in your transactions and we share customer information related to those transactions with that third party.

– Third Party Service Providers:
We employ other companies and individuals to perform functions on our behalf. Examples include sending e-mail, hosting our files, removing repetitive information from customer lists, analysing data, providing search results and links (including paid listings and links), processing credit card payments and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes. Further, they must process the personal information in accordance with this Privacy Notice and as permitted by applicable data protection laws.

– Business Transfers:
As we continue to develop our business, we or other subsidiaries controlled by ShiVaTech might sell or buy stores, subsidiaries or business units. In such transactions, customer information generally is one of the transferred business assets, but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the customer consents otherwise). Also, in the unlikely event that ShiVaTech or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

– Protection of ShiVaTech and Others:
We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Conditions of Use and Sale and other agreements; or protect the rights, property or safety of ShiVaTech, our users or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing or otherwise disclosing personally identifiable information from customers for commercial purposes in a way that is contrary to the commitments made in this Privacy Notice.

Whenever we transfer personal information to countries outside of the European Economic Area in the course of sharing information as set out above, we will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by EU laws on data protection.

Data Security

We take precautions to protect your information. When you submit sensitive information via the website, you can choose to send your data over an encrypted connection. Although we do not handle critical information such as credit card or bank data ourselves, you may still want to send your name, e-mail address, address etc. securely. To do so, you must visit the “https://” version of our websites. You can verify your connection by looking for a lock icon in the address bar and looking for “https://” at the beginning of the address of the Web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Passwords to your accounts are not stored as plain text, but instead as secure hashes. We could not reconstruct your passwords even if we wanted to. If you forgot your password, or are not sure which password belongs to which of our services, please request a password reset or use the automated forms on our store, forum or bugtracker.

Data Backup Policy

Companies have to provide for IT security and data backup. ShiVaTech backs up its main websites and customer databases regularly through an automated system. We keep incremental revision backups for up to 4 months, which will keep your personal information for up to that period of time even after you adjust your information or requested deletion. These backups are for maintenance and security purposes only and will not be used in normal day to day operations.

Declaration of Obligation to Maintain Confidentiality

ShiVaTech promises to treat any and all confidential information received from customers as strictly confidential and only to make this information available to the administrative bodies, staff and consultants of his organization and affiliated organizations and their administrative bodies in so far as these are actually involved in providing ShiVa-related services to the customer. ShiVaTech undertakes to expressly inform recipients of confidential information that this confidential information is only intended for use related to ShiVa and ShiVa-centric services, that duplication of this information or the passing on of this information to third parties is forbidden and that a duty to return or destroy/delete confidential information and any and all documents or data resulting from this information as well as any copies of the same exists, if this has been requested, and if this request to delete data does not conflict with any legal requirements.

Conditions of Use, Notices & Revisions

If you have any concern about privacy at ShiVaTech, please contact us with a thorough description and we will try to resolve the issue for you. Our business changes constantly and so do our Privacy Notice, Terms of Service, Provider agreement etc. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our website frequently to see recent changes.
